Wedding Tracker, a division of The Knot Inc. (“Wedding Tracker” or “Wedding Tracker”). These
Terms of Service govern your use
of Wedding Tracker’s service. Your use of Wedding Tracker’s services constitutes
acceptance of these Terms of Services and creates a binding legal agreement.
Please read the Terms of Service carefully.
All legal issues arising from or related to the use of this service shall be construed in
accordance with the laws of the State of New York without regard to conflicts of law principles.
These Terms of Service constitute the entire agreement between you and Wedding Tracker with
respect to the use of this service. Wedding Tracker’s failure to enforce any right
or provision in these Terms of Service shall not constitute a waiver of such right or provision or
of any other rights or provisions in these Terms of Service. If a court should find
that one or more rights or provisions set forth in these Terms of Service are invalid, you agree
that the remainder of the Terms of Service shall be enforceable and that the invalid provision
shall be enforceable to the fullest extent permitted by law.
Wedding Tracker reserves the right to amend these Terms of Service from time to time.
These changes will be reflected in the Terms of Service as seen on
our website.
Registration
You agree that the information that you provide to us on registration and at all other times
will be true, accurate, current and complete. You also agree that you will ensure
that this information is kept accurate and up to date at all times.
This is especially important with respect to your email address, since that is the primary
way in which we will communicate with you about your account and your orders.
We will use the information you provide to us in accordance with our Privacy Policy.
Length Of Service
Wedding Tracker provides service subscriptions in annual increments only.
This is because domain names can only be registered in annual increments.
Service Level Agreement
Wedding Tracker will provide a 99% availability of its web site,
www.weddingtracker.com,
and the web site’s that it powers (e.g. www.amandaandscott.com).
Occasional service outages may occur that Wedding Tracker cannot control.
If such outages occur, Wedding Tracker will work on restoring service as soon as possible.
Wedding Tracker is not liable or responsible for damages if such outages occur.
Wedding Tracker will provide all customer service and support.
We are not yet set up for telephone support and are best contacted via email at
support@weddingtracker.com.
We will respond to all customer service inquiries, usually, within twenty-four hours of receipt,
Monday through Friday, 6:00AM to 5:00PM PST.
Fees and Refund Policy
All fees for Wedding Tracker services and products will be provided to Wedding Tracker
in US dollars. All fees will be collected via a valid credit card.
You may cancel your account at anytime during the two-week free trial, provided the conditions
set forth below.
Wedding Tracker will issue a refund within two weeks of your two-week free trial expiration
provided that you have not published your web site.
Wedding Tracker will not issue a refund if you have published your web site.
If you publish your web site during your two-week free trial, thereby selecting a domain name
and allowing your web site to be viewed online, you will forfeit the remainder of your free trial,
you will no longer be in your free trial period, and your subscription will begin.
Wedding Tracker provides a clear statement of these terms when you publish your web site during
the free trial period.
Service Renewals: Wedding Tracker will not provide a refund of any renewal service that
includes the use of a domain name.
This includes the web site and planning software package and the domain name only package.
Wedding Tracker will provide a refund of the planning software package if the refund is
requested within two weeks of the renewal transaction.
Photos and Photo Products: Wedding Tracker will not provide a refund for any photo or photo
product order. All photo and photo product sales are final.
Domain Name Usage and Ownership
During the length of service, Wedding Tracker is the legal owner/registrant of the domain
name you publish your web site to.
We reserve the domain name you choose for the exclusive use of your web site.
This domain name cannot be transferred during your subscription.
Upon publishing your Wedding Tracker web site and selecting a domain name, it may take up to
twenty-four hours for your web site to be viewable online.
This is out of our control and due to the global domain registry.
You may choose to have a domain name you already own point to the web site you
create with Wedding Tracker. With such a domain name, you’ll need to change
the DNS settings or Host Server with your registrar to do a redirect/forward to
the domain registered with Wedding Tracker.
Within two weeks of your web site expiration, you will be given the ability to renew only
your domain name. This renewal will transfer the domain’s ownership to you and
you will be given access to our domain management web site,
Tracker Domains.
Web Site Content
Wedding Tracker does not control the content of any user’s account and does not have
any obligation to monitor such content for any purpose.
All content provided by a user of Wedding Tracker services is the sole responsibility
of that user. Wedding Tracker will not power any web site that contains
pornographic, offensive, or unlawful material. Upon discovery of such material,
Wedding Tracker reserves the right to remove the material and terminate your subscription.

Wedding Tracker is strongly committed to your right to privacy and to taking steps
designed to secure your personal and financial information.
To earn your trust and confidence in our commitment, the intent of this policy is to fully
disclose our privacy practices to you. We will only use your personal information
in accordance with this Privacy Policy. We encourage you to read our policy to
understand the types of personal information we collect and how this information is used.
Your Consent
By using our site, you consent to the collection and use of your information as described in
this Privacy Policy. Any changes to our Privacy Policy will be reflected on this
page so that you are always aware of the information we collect and how we use it.
The Personal Information We Collect
Wedding Tracker collects personal information necessary to respond to your requests for
our customized products and services and to allow you to use the resources available on both ours
and our sales agents/affiliates websites, including the creation and maintenance of a Wedding Account and a Wedding Website.
Personal information includes, but is not limited to, name, physical address, email address,
phone number, age and any other information that itself identifies or, when tied to the above
information, may identify you as a specific individual. Wedding Tracker also
collects information related to your wedding, including dates and places of the rehearsal,
wedding and reception, name, address and phone number of wedding guests, and information
relating to your gift registry and honeymoon. Wedding Tracker also uses order
forms for you to sign up for products and services. On such order forms, we collect
your contact information, financial information (including credit card numbers) and demographic
information.
Cookies
"Cookies" are small pieces of information that are stored by your browser on your computer’s
hard drive. We use cookies in several ways (and thousands of other sites are
currently using them too!). Cookie files are used to better understand how you go
through our website so that we may tailor your experience at our website.
Cookies are also used to tell us whether you have visited our website previously,
and to help us determine whether you came to our website from a particular Internet link or
banner advertisement. Cookies can also be used to help you to save and retrieve
passwords and other information and preferences you use on our website, saving you from having

When you connect to our website, we record your IP addresses and information on the type of
operating system (e.g. Windows98) and browser software (e.g. Microsoft Internet Explorer and
Netscape) you are using. This helps us to diagnose problems with our servers
and for system administration. Your IP address is also used to help gather aggregated
demographic information.
With Whom Your Information Is Shared and How It Is Used
When you provide information to Wedding Tracker, the information is stored in our
databases. We use such information in accordance with this Privacy Policy.
Information we collect is used to tailor your experience at our site, to show you content
that we think you might be interested in, and to display the content according to your preferences.
We also use such personal information to send you information and promotional materials regarding
our service. Your contact information may also be used if it becomes necessary to
contact you.
Currently, any information we collect will not be shared with any third parties.
However, we reserve the right to share this information with select partners, suppliers, and
advertisers in the future. Please note that this refers to your information only.
Any information regarding your wedding and event guests will not be shared with any third parties
and will not be used for any promotional purposes.
In addition to the circumstances described above, we may disclose your information if required
to do so by law, court order, as requested by other government or law enforcement authorities,
or in the good faith belief that disclosure is otherwise necessary or advisable, including
(without limitation) when we have reason to believe that disclosing the information is necessary
to identify, contact or bring legal action against someone who may be causing interference with
our rights or properties, whether intentionally or otherwise, or when anyone else could be
harmed by such activities.
The Choices You Have About The Collection and Use Of Your Information
As a user or customer you will occasionally receive e-mail updates from Wedding Tracker about important
functionality changes, special offers from us, new services and other noteworthy news items
about us. We hope you will find these updates interesting and informative.
Of course, if you would rather not receive them, just let us know by adding your email address
to our remove list.
In other words, if you don't want us to send you promotional e-mails, just let us know.
Wedding Tracker reserves the right to limit registration to those who will accept emails and
to those who will provide the requested information.
Your Ability To Access, Update or Correct Your Information
At any time, you can view and/or update all of the information contained in your account or
wedding website by logging in to your account and following the appropriate links.
Your account login can be easily accessed by visiting our home page at www.weddingtracker.com.
However, even if you delete or change some personal information in our registration database,
it may still be stored on our databases (including those kept for archival purposes).
The Security Measures We Take To Protect Your Personal Information
All account information you provide to us when signing up, including credit card information
is transmitted using SSL (Secure Socket Layer) encryption.
SSL is a widely used coding system that lets your browser automatically encrypt or scramble
data before you send it to us. Only authorized personnel from Wedding Tracker
can decode this information and such personnel will only do so in accordance with our Privacy
Policy. In addition, to attempt to deter the theft of credit card numbers and other
personal information residing in our system, we have installed secure "firewalls" and have
implemented other security measures to help protect our systems against "hacker" break-ins.
Third Party Service Providers
We may share your personally identifiable information with those companies that assist us in
providing Wedding Tracker service to you, including companies from who may have referred
you to our products. Examples of our use of third party
service providers: We may share your credit card information with a financial institution to
affect your purchase of our services or products using your credit card. We may share
personally identifiable information (not including credit card information) with third parties
that assist us with the administration or fulfilment of your account.
Copyright
Wedding Tracker respects the intellectual property rights of others.
Wedding Tracker claims no ownership rights in any image contained on your web site and will
not share your images unless instructed by you or otherwise required by law.
Please note that when you upload images and allow your web site guests to view them,
you allow your guests to share and make photographic prints from the images contained on your
web site. You may opt-out of allowing your web site guests to purchase
photographic prints from the images contained on your web site through us.

Please be aware that on our site we may have advertisements and links to other websites that
may collect personal information about you. This Privacy Policy does not cover
the information practices or policies of such websites.

be materially different from our Privacy Policy.
Any material changes in the way we use personal information will be described in future
versions of this Privacy Policy. Of course, you may always submit concerns regarding

You must provide the following information, which Wedding Tracker may then forward to the
alleged infringer:

Upon receiving your complaint, Wedding Tracker may remove content that you believe infringes your copyright.
In addition, Wedding Tracker may terminate the
account of the member who appears to be infringing your intellectual property rights.
Wedding Tracker claims no ownership rights in any image contained in any of the web sites it
powers. Please note, however, that when you share your web site, you allow your web
site guests to share and make photographic prints from the images contained on your web site.
For the sole purpose of displaying your images through your Wedding Tracker web site,
and fulfilling any orders you or your web site guests place, you grant to Wedding Tracker a
non-exclusive, royalty-free license to use, copy, distribute, and display those images.
Wedding Tracker provides the ability to opt-out of allowing your web site guests to purchase
images displayed on your web site.
Your Conduct
You are responsible for all of the images you upload, share or copy using Wedding Tracker’s
service. You must have the legal right to display each image that you upload or share,
and to copy each image that you order prints of. Professional images that are provided
to you by professional photographers or made available through web sites magazines,
books or other resources, are protected by copyright and should not be uploaded, shared or
copied using this service.
In addition, the actions further described below, will constitute grounds for blocking your access
to our service, removal of posted material and non-fulfillment of your order (or any part of your
order). As condition of your use of this service, you shall not: upload, post,
order for print, email or otherwise transmit any content that is unlawful, harmful, threatening,
harassing, defamatory, obscene, vulgar, invasive of another's privacy, hateful, or otherwise
objectionable; upload, post, order for print, email or otherwise transmit any content that you
do not have a right to transmit under any law or under contractual or fiduciary relationships
(such as insider information, proprietary and confidential information learned or disclosed as
part of employment relationships or under nondisclosure agreements) or any content that infringes
any trademark, trade secret, copyright or other proprietary rights of any party; harm minors in
any way, including, but not limited to, content that violates federal and state child pornography
laws, child sexual exploitation laws and laws prohibiting the depiction of minors engaged in
sexual conduct; forge headers or otherwise manipulate identifiers in order to disguise the
origin of any content transmitted through this site.
Wedding Tracker reserves the right to refuse to fulfill any order, or any part of any order,
if it believes that these Terms of Service have been violated.
In addition, Wedding Tracker reserves the right to disclose any account or order information
when it believes in good faith that the law or legal process requires it, or when it is necessary
to do so to protect the rights or property of Wedding Tracker or others.
Trademark and Copyright
Wedding Tracker and all graphics, logos and service names used to identify The Wedding
Tracker’s products and services are trademarks of Wedding Tracker, a division of The Knot.
Third party trademarks used in connection with this service are the property of their respective
owners. You are not entitled to use any trademark in connection with any product or service
without the express permission of the owner of that trademark.
You should assume that all of the content or other works made available to you through the
service (together, the "Content") is protected by copyright or other proprietary rights.
You are not entitled to duplicate, create derivative works of, distribute, display or perform
any Content without the express permission of the owner of that Content.
Web Site Content

purpose, and non-infringement, are expressly disclaimed. To the fullest extent
permitted by law, Wedding Tracker and its sales agents disclaims any warranties for the security, reliability,
timeliness, and performance of this service.
You understand and agree that the submission of digital image to Wedding Tracker,
and the download of any material through Wedding Tracker’s service is done at your own
discretion and risk and that you will be solely responsible for any loss or damage to your image,
any loss of your image and any damage to your computer system or loss of data that may result
in the download of any material. You are solely responsible for creating back-ups
of your digital images.
Except as expressly provided in the preceding paragraph, to the fullest extent allowed by law,
Wedding Tracker and its sales agents shall not be liable for any direct, indirect, incidental, consequential,
special, exemplary, and punitive damages resulting from the use or provision of The
Wedding Tracker’s service or site, even if Wedding Tracker has been advised of the
possibility of such damages. The foregoing disclaimers, waivers and limitations
shall apply notwithstanding any failure of essential purpose of any limited remedy.
